Getting charged with a weapons offense in Texas can quickly transform your otherwise normal life into a legal battle that can result in serious consequences. One of the reasons you may find yourself facing charges is getting caught with a prohibited weapon.

The Texas Penal Code outlines the weapons that are considered prohibited and illegal to possess, carry or use. These weapons include the following.

Short-barrel firearms and machine guns

Short-barrel firearms, including rifles with barrels under 16 inches long and shotguns with barrels under 18 inches, are restricted under Texas law. Machine guns, which can fire continuously with a single trigger pull, are also prohibited unless properly registered with the ATF in the National Firearms Registration and Transfer Record.

Explosive weapons and improvised explosive devices (IEDs)

Explosive weapons, such as bombs, grenades or devices designed to release a massive amount of energy in an uncontrolled manner, are illegal in Texas unless registered with the ATF. Improvised explosive devices (IEDs) are homemade explosives and are similarly prohibited under state law.

Armor-piercing ammunition

This type of ammunition is designed to go through bulletproof vests or other forms of protective armor. Possessing armor-piercing rounds is illegal in Texas unless the ammunition is specifically authorized and registered. These rounds are heavily regulated due to their potential to bypass standard safety measures, making them prohibited for civilian use.

Chemical dispensing devices

Chemical dispensing devices, such as those designed to release harmful chemicals like tear gas, are prohibited in Texas unless used by law enforcement or military personnel under specific circumstances. These devices can cause significant harm and pose a serious public safety risk, making their possession illegal for civilians without proper legal justification.

Zip guns

Zip guns are homemade firearms often made from readily available materials. While these weapons are not manufactured according to standard firearms regulations, they can be easily concealed and are considered extremely dangerous.

Tire deflation devices

Tire deflation devices, such as spike strips, are used to puncture or deflate the tires of vehicles. These devices can be used by law enforcement to stop fleeing suspects but are prohibited for civilian use.

If you are charged with possessing any of these items, obtaining legal guidance can be key to protecting your rights and navigating the legal process.
