Why a child may need an increase in child support

On Behalf of | Feb 3, 2025 | Family Law |

Child support is standard after parents separate or divorce. The paying parent will contribute financially to the daily living expenses, education, medical care and other child needs.

Generally, the court sets a fixed amount considering the child’s needs and each parent’s financial circumstances. However, in some cases, the initial amount of support may need to be modified. What are some of the main reasons for this?

When the child’s needs change

Children’s needs change as they grow up. For instance, they may start to engage in extracurricular activities. Or the child may require special educational services. In such instances, the paying parent may be required to pay an increased amount of child support to cover additional costs.

Unforeseen medical expenses

A child may develop a health condition that requires medical treatment. If the custodial parent has been hit with this news suddenly, it can take a financial toll. Generally, the paying parent is expected to share some medical expenses and financial burden. Sudden news that the child has developed a health condition is a valid reason for a child support increase.

Cost of living

Most people are feeling the pinch financially just now, and this includes parents. A child support payment may become outdated if it does not reflect inflation and rises in the cost of living. As long as the custodial parent can present a compelling argument, the rising cost of living can require increased child support.

Child support laws in Texas are nuanced. The best way to ensure you are paying or receiving a fair amount is to seek legal guidance.
